NEWS RELEASE:  MILITARY SAILOR FOUND NOT GUILTY ON THREE CHARGES OF ASSAULT AND BATTERY OF HIS WIFE

Virginia Beach Criminal Attorney Jason Swango, of Swango Law P.C. successfully defended a U.S. Navy sailor in three separate trials of assault and battery filed against him by his wife.  I believe that these charges were filed frivolously by the wife and my client was exonerated on the charges.  We are extremely happy that this nuclear specialist can move on with his life and enjoy the freedoms that he provides for us all, says Swango.

Domestic Assault (Military Member/Spouse):

Not Guilty – case dismissed with prejudice.

Here, a military member was charged by his spouse for assault and battery.  Attorney Swango successfully, under the nose of the prosecutor, introduced evidence from the charging party on cross examination that a previous restraining order was dismissed by another judge.  The alleged victim got mad, tried to avoid the rest of the cross examination questions.  Attorney Swango successfully pointed out to the judge that at the time of the temporary restraining order, the spouse came to the military members house, thus taking the State’s police powers in her own hands, and after cross examination she admitted that she would have sat in front of our clients car to prevent him from leaving, we affectively allowed her to tighten the “testimonial rope” around her neck and secured a victory.

Permanent Restraining Order Against Husband (Military Member)

Dismissed

Here, military member spouse took out temporary restraining order that made father turn over custody of his children to the mother.  After cross examination, the permanent restraining order petition was dismissed against our client.

Domestic Assault (Girlfriend)

Here, girlfriend claimed that client hit her after she woke up because he had another girl in the house.  Other girl was friend who was staying in spare bedroom.
